Program Overview
Prominent South Carolina attorney Alex Murdaugh was convicted of Murder, and he filed a motion for new trial alleging the clerk of courts tampered with the jury by advising them not to believe Murdaugh’s testimony and pressuring them to reach a quick guilty verdict. The South Carolina Supreme Court agreed stating the State’s “efforts were in vain because Colleton County Clerk of Court Rebecca Hill placed her fingers on the scales of justice, thereby denying Murdaugh his right to a fair trial by an impartial jury.” In this presentation attendees will watch film clips of this trial and examine how Murdaugh’s right to a fair and impartial jury was violated. Further, attendees will learn how parties ignored signs of jury tampering. Most importantly attendees will learn how to prevent their cases from being overturned because of jury misconduct or jury tampering. Finally, we will review ethical issues that arise when attorneys confront juror misconduct including Rules of Professional Conduct 3.3, Candor Towards the Tribunal, Rule, 1.6, Confidentiality of Information, and Rule 8.4 Special Responsibilities of a Prosecutor.

Philip Bogdanoff, a nationally recognized presenter who has over 40 years of experience as a prosecutor and has litigated cases involving allegations of juror misconduct. Previously, he served as an assistant prosecutor in Akron, Ohio for close to thirty years. Mr. Bogdanoff argued cases before the Ohio Ninth District Court of Appeals and twenty cases before the Ohio Supreme Court including six death penalty cases - before retiring as a senior assistant prosecutor. North Carolina State Bar, Board of Continuing Legal Education
Credit has been approved with the North Carolina State Bar, Board of Continuing Legal Education for 1.00 Ethics credit and 2.00 General credits.
This is a joint policy of the 26th Judicial District Bar (the 26th), the Mecklenburg Bar Association (MBA), and the Mecklenburg Bar Foundation (MBF). Registration refunds are 1) 100% refundable for requests made 10 or more days before the event; 2) 75% refundable for requests made nine to six days before the event (a 25% processing fee will be incurred); and 3) non-refundable for requests made five days or less before the event. Registrants requesting refunds five days or less before the event may be offered the option to transfer the registration to a substitute attendee. Payment is due in full if no cancellation is received or if cancellation is received five days or less in advance of event.
Tickets purchased from outside vendors may not be refundable.
Late registrations, following the registration deadline or at the event door, may be accepted on a space available basis--additional charges may apply. For some events, food or beverage is not guaranteed for last-minute registrants.
A sponsorship and/or advertisement refund will only be granted in the case that the 26th, MBA, or MBF does not fulfill the commitment(s) agreed upon in writing.
Exceptions (such as in the event of cancellation or postponement due to inclement weather) or other requests for refunds not covered by this policy will be considered for approval by the Executive Director or his or her designee.
