Real estate transfers in North Carolina require precision, especially within the state’s unique probate and estate framework. When the property is titled in the name of a deceased owner, the process can become even more complex. Misinterpretations or differing opinions on the law often result in confusion when dealing with banks, title insurance companies, or fellow attorneys. This concise presentation will break down the statutory laws governing real estate transfers after an owner's death. It will provide a clear framework for ensuring the transfer is legal and effective, addressing the treatment of proceeds and taxes, and highlighting common pitfalls to avoid in post-death real estate titling.

John Riordan, Fidelity Law Group
John is a managing member at Fidelity Law Group, a growing firm serving the Piedmont Triad area. He has been practicing probate and estate administration since 2021 and today those areas dominate his practice. He also has experience in civil litigation, including litigation involving estates and fiduciaries. His experience gives him unique insight into the do’s and don’ts of probate and estate administration, as he knows both the transactional and litigation sides of the practice. When he’s not working, John enjoys spending time in and around Charlotte with his wife, three kids, and friends.

Credit has been approved with the North Carolina State Bar, Board of Continuing Legal Education for 1.00 General credit.
Registration refunds are 1) 100% refundable for requests made 8 or more days before the event; 2) 75% refundable for requests made 7 to 4 days before the event (a 25% processing fee will be incurred); and 3) non-refundable for requests made 3 days or less before the event. Registrants requesting refunds 3 days or less before the event may be offered the option to transfer the registration to a substitute attendee. Payment is due in full if no cancellation is received or if cancellation is received 3 days or less in advance of event.
Reservations are not guaranteed if received less than 24 hours prior to the event. Registrations at the event door will be accepted on a space available basis--additional charges may apply. For some events, food or beverage is not guaranteed for last-minute registrants.
A sponsorship and/or advertisement refund will only be granted in the case that the Mecklenburg County Bar does not fulfill the commitment(s) stated in the signed "Sponsorship/Advertisement Agreement".
